Many motorists had to be fined by the CSN inspectors for the lack of a “Sh” sign when the vehicle had studded tires. In a particular case, the actions of the traffic police inspectors are completely illegal, because they replace the items.

So the sign "Thorns" is really obligatory?

Winter in most regions of Russia is replete with precipitation and sleet on the road. The ice crust on the road surface significantly impairs the adhesion of automobile wheels to asphalt or soil. Therefore, braking on ice is often not very effective and, as a rule, leads to a skid of the vehicle.

As a drastic measure to combat this scourge, many motorists equip their car tires with special studs that allow the driver to better control the car on a slippery, ice-crusted road. Since such a device affects the driving parameters of vehicles, a special pictogram must be on the rear window of the vehicle to warn drivers driving vehicles behind.

This “Ш” sign should be installed only on those vehicles on the wheels of which there are studded tires. The purpose of such a sign is to protect all participants in the DD. Wheels with studded tires can lose their studs while driving and can cause damage to nearby vehicles and pedestrians.

What is the fine provided in 2017 if there is no “Sh” sign

Decree of the Government of Russia No. 333 dated March 24. 2017 states that from 04.04. 2017, the traffic police inspector may prohibit a motorist from driving a vehicle with studded tires if such a vehicle does not have a “Sh” sign.

Sanctions for such a violation are predetermined by Part 1 of Article 12.5 of the Code of Administrative Offenses of Russia. The motorist is threatened with a warning or he can be fined in the amount of 5 hundred rubles.

Installation of the sign "Sh"

In clause 08 of the Basic Provisions on the admission of vehicles to drive with studded tires, there must be a sign in the form of an equilateral triangle with a red and a capital letter "Ш" in the middle of the triangle on a white background.

These requirements are explained by the concern for the safety of all, without exception, participants in the DD, because the wheels of vehicles with spikes can easily cause a very serious accident:

The braking distance of a vehicle with studded tires is somewhat shorter than that of a vehicle of the same brand and configuration, without studded wheels.

So, a person driving a car moving behind, most likely, is unlikely to have time to react and stop in time, as many rely on personal experience and keep a safe distance based on the braking performance of vehicles with standard tires.

Poor-quality tire studding is manifested by flying spikes when driving, which can damage the front glass of the car following behind. In addition to spikes, stones often fly out from under the wheels of a vehicle.

"W" should be clearly visible from 20 meters, and therefore should be mounted on the rear window of the car. But if the car windows are tinted, then from its outer side.

Liability of the motorist in the event of an accident

If the owner of the car decides to ignore the requirements of the law, then he should prepare for the most negative consequences. In the event of an accident, a formally guilty motorist who crashed into a car with studded tires has the right to sue a careless motorist who did not deign to warn the other participants in the DD about the features of his car.

Practice has repeatedly shown that judges often lay responsibility for the incident on both motorists. And this is important when resolving your issues with an insurer company: usually, the first and second car owners have to repair damaged vehicles at their own expense. So, the management of the vehicle implies mandatory strict observance of the rules of the DD, and in addition, a respectful attitude towards other participants in the DD. In the end, this behavior also affects the safety of the motorist himself.

Various amendments have been repeatedly applied to the sign "Spikes". Many controversial points in the practice of this symbol have been discovered.

Dear readers! The article talks about typical ways to solve legal issues, but each case is individual. If you want to know how solve exactly your problem- contact a consultant:

APPLICATIONS AND CALLS ARE ACCEPTED 24/7 and 7 days a week.

It's fast and FOR FREE!

Drivers did not raise it to the end, where exactly it should be placed, what dimensions of the plate should be, and more. For example, changes were introduced from April 4, 2017, and also from June 1, 2020.

Incorrect placement, absence, or a sticker of the wrong size was punished with monetary penalties - violators were fined. But now the situation has changed radically, so you should carefully study the situation regarding the sign "Thorns".

What does

The car sign "Spikes" denotes the timely use by motorists of winter tires on wheels, which is equipped with a special tread surface - spikes.

The anti-skid system allows vehicles to brake normally on snowy or icy roads. The length of the inertial movement with brakes using such wheels is reduced.

Three types of winter tires:

  1. studded– metal spikes are built into the rubber, allowing the wheel to stop its course much faster, given the complexity of the road surface in winter.
  2. grooved rubber- deep tread "patterns" allow the wheels to "stick" a little to the icy or snowy surface. This makes braking faster.
  3. Combined– deep recesses on the protectors are combined with spikes.

In addition to these options, there is also universal rubber, which is suitable for demi-season use. But it is only suitable for regions where there is no harsh and long winter.

The very designation, which is attached by drivers on the back of the car itself, is designed to inform other road users about the presence of:

  • on studded tires;
  • shortened braking distance;
  • the likelihood of a spike hitting the windshield if it flies off a slope of poor quality material, and the rear car drove too close.

Such notification allows other motorists to correctly determine the moment of braking of their car, because the braking distance of the vehicle in front will be much shorter.

Timely orientated participants traffic can prevent accidents on winter roads.

Orientation is to keep a decent distance from those cars that signal with a sign about the presence of studded tires on wheels.

When introduced

The "Spikes" sign was part of all warning information signs of a road nature back in 1993, when it was finally formed.

Back in 2017, such a sign was required for mandatory presence on cars equipped with spiked ramps on wheels. Such regulations were introduced into the Rules, which entered into force on April 4 of the same year.

At the same time, the norms stated that if there is no such sign, then this will be regarded as a malfunction of the vehicle.

This means that the car could easily have been towed to the impound lot and the driver banned from driving until the problem is fixed. A fine was also determined for such an offense - 500 rubles (part 1).

Since June 1, 2020, this sign has already been removed from the Rules - clause 8. This was done by excluding a paragraph from the text of clause 8 of the SDA.

Now the presence of this signal "board" on the back of the body or glass of the car is not an obligation for motorists.

What does the spike sign look like and its dimensions according to GOST

The appearance of the designation, signaling the presence of reinforced winter tires on a car, is represented by GOST in the form of a triangle, inside which is the letter "Ш", symbolizing the abbreviation of the corresponding word.

The plate itself and the drawing must have standard sizes. Otherwise, the use of the wrong size will lead to fines that the traffic police will issue for using an atypical sign.

Table of characteristics of the sign "Spikes":

There is an important nuance associated with the use of the "Spikes" plate and car insurance. Motorists may be concerned about whether insurers will refuse to pay out if the car did not have a sticker warning the presence of studded tires, but it happened through the fault of another participant.

The answer in this case is negative - the law does not say that insurance companies have the right to refuse to pay out insurance due to the absence of this mark.

Where should the sign be?

Traffic regulations do not expect drivers to stick the sign on the rear window. There is no specific location for the signal plate on the vehicle.

But an important detail is prescribed - it should be installed, glued only in the rear of the vehicle and it should be visible to other road users.

Such requirements imply the use of the sign for its intended purpose, when it will fully fulfill its practical tasks.

On the other hand, a sticker on the rear window in the center, with a slight offset to the right or left of the center of the glass, will interfere with the driver's view of the situation on the road.

Assessment of the environment while moving along the highway is not only due to rear-view mirrors, parking sensors (sonars, parking radars, rear view camera).

But you can also inspect what is happening behind the car, using the elementary rear window of the body. But if a sign is pasted on it, it will greatly interfere with normal visualization.

The best option for placing a sign:

  • on the rear window directly behind the driver;
  • on the rear window in the lower right corner;
  • on the body of the body at the back, but in such a way as not to cover other important designations - the logo of the car brand, the license plate of the car, etc.;
  • from inside the passenger compartment on the rear window, so that the sticker image is not quickly damaged by the effects of weather conditions on the sticker.

Advantages and disadvantages

The requirements of the traffic police service have been weakened in relation to the mandatory presence of the “Spikes” symbols on the car, if the wheels are actually winter tires.

But this does not mean that drivers are not allowed to use such a sign. Its use can significantly improve the comfort of motorists passing on the roads. But there are also disadvantages.

The benefits include the following features:

  1. Reducing the risk of collision due to non-observance of the distance by cars and the difference in the braking trajectory between a car with studded wheels and a car with “bald”, summer tires.
  2. The car owner protects his car from skidding on snowy roads, in bad weather, and, accordingly, from the risks of rolling over, colliding with an immovable object due to loss of control on an icy road.
  3. A key role in determining the perpetrators of an accident on the road. If the driver did not keep the distance from the car with such a sign, drove into her bumper, then he, and not the injured party, will bear responsibility.

In the absence of a sign and in the presence of studded tires, both cars will be guilty of a collision, or the owner of the car, who did not put a warning sticker on the car.

As a result, the other participant could not correctly calculate the speed of his car, the start time of braking, and the distance.

The disadvantages are:

  1. In cases where the rubber is not of the required quality, the studs often fly out under pressure during the rotation of the wheels. This spoils the treads and creates a dangerous situation on the road - spikes at speed can fly into the windshields of cars driving behind.
  2. Some unscrupulous motorists do not remove this sign even in the warm season when changing wheel tires to the summer version. Thus, they seek to organize the distance so that other drivers distance themselves from them as much as possible.
  3. Inaccuracies of meaning in the Rules regarding the location of the plate.
  4. Passing inspection, the presence of the sign should have been mandatory. Since, according to last year's rules, this referred to the serviceability of the vehicle.

Now you can buy a sticker with the symbol "Ш" in a triangle in any store of car accessories and parts. Approximate cost - 500-800 rubles on average.

They are attached not only to the adhesive base, but there may be models with suction cups, or on magnets. Do not attach magnetic options to glass.

Therefore, they are installed on the back of the case. But how convenient and reliable it is is the question. You can try to find a model that allows you to mount the fixture on metal from inside the cabin so that the sign is visible through the rear window.

Why the mark was excluded from the new rules

The new version of the Rules for Road Traffic (SDA) does not include in clause No. 8 the obligation of motorists to place the “Spikes” sign on a vehicle.

Reasons for exclusion from the list of mandatory road signs of the designation "Ш":

  1. Inappropriate use of the mark. The braking distance in specific weather conditions, even with studded wheels, is increased.
  2. Not every rubber equipped with a lip system or spikes can shorten the braking distance.
  3. The lack of specifics in the traffic rules about the location of the plate. In view of this, some motorists simply kept it in their cabin without showing it to other participants.
  4. The magistrates and the policemen of the road service did not take into account the mutual, if the victim’s car had spikes and he did not have a warning sign.

According to the amendments to the "Rules of the Road", effective from 04.04.17, in Russia it is mandatory to use the "Spikes" sign on cars with studded winter tires installed.

However, not all car owners know about this, and the vast majority drive without this sign, which is fraught with certain troubles for them with traffic police inspectors.

From this article you will learn:

What determines the mandatory installation

The obligatory installation of the “Spikes” sign on a car is determined by clause 7.15 of the “Amendments to the SDA” dated April 04, 2017, which lists a list of malfunctions in which the operation of the car is prohibited. Literally, in paragraph 7.15 it is written as follows:

There are no identification marks, which must be installed in accordance with paragraph 8 of the Basic Provisions for the admission of vehicles to operation.

At the same time, in paragraph 8 of the Basic Provisions for the admission of vehicles for operation, the following is literally written:

Vehicles must be marked with:

- "Spikes" - in the form of an equilateral triangle of white color with the top up with a red border, into which the letter "SH" is inscribed in black.

That is, driving without an installed “Spikes” sign on a car with studded winter tires installed has been considered illegal since 2017. By the way, now everyone can easily break through a car by license plate on the current base.

What is it for

It must be said that the need to install a sign is determined not only by legislation, but also by common sense.

Today, the choice of winter tires is huge, (Velcro) is chosen by an increasing number of car owners. However, even in big cities there are many situations when they have a shorter stopping distance than Velcro.

A highly visible "Spikes" sign can actually warn the driver behind you that the braking distance may be much shorter than he expects. That is, the presence of a sign, in fact, is an additional factor that reduces the accident rate on the roads. There is no need to neglect them.

Penalty for the sign "Thorns"

Since the absence of the “Spikes” sign is now considered a malfunction, according to Part 1 of Article 12.5 of the Code of Administrative Offenses, traffic police inspectors have the right to impose a fine of 500 rubles on the car owner.

Literally, part 1 of Article 12.5 reads as follows:

Driving a vehicle in the presence of malfunctions ...

... shall entail a warning or the imposition of an administrative fine in the amount of five hundred roubles.

That is - if the car owner is very lucky and the traffic police inspector will be in good mood, then he will be able to count on a warning. But with a high probability we can say that there will be a fine.

Where to glue the sign "Spikes" on the car

Many car owners also often have a question, where to glue the “Spikes” sign? It can be difficult to independently determine the place where it should be installed (there are many options - on the door or trunk lid, on the bumper, on the rear lid of the body, on the awning, someone even glues it to the wardrobe trunk attached to the roof rack).

It should be noted here that in addition to paragraph 8 of the "Basic Provisions for the Admission of Vehicles for Operation", no other documents, including the "Rules of the Road", specify the location of the sign on the car.

Literally, in paragraph 8 of the "Basic Provisions" the following is written:

The sign must be installed behind motor vehicles.

That is, the sign should simply be visible and well readable for those road users who are driving behind your car.

As for the sign sticker itself, here you need to remember the following:

  1. Since the sign must be placed only in the winter (it is not needed in the summer), it must be borne in mind that the sign pasted in the fall will have to be removed in the spring. And this may not be so easy and may even damage the paint or the glass itself on the car if the wrong place is chosen.
  2. There are two types of signs - with glue on the front side of the sign and with glue on the back of the sign. Accordingly, those signs that have glue on the front side are glued from the inside of the car, which on the back side are outside the car.
  3. Signs are produced by many manufacturers, for many of them the adhesive base can seize excessively “tight”, which will create a lot of difficulties when peeling off the sign in the spring. On the inside of the car glass, its heating threads can be damaged, and on the outside, even the paint on the car body can be damaged.
  4. To prevent this from happening, it is best to choose places where you will certainly not be able to damage the car. For example, car glass is perfect for any glue, since it will be much easier to scrape off the remains of the sign and glue from it than from any other surface. True, if a sticker is supposed to be inside, it is necessary that there are no heating threads on the glass.
  5. When sticking a sign on a car window, do not forget about visibility. The sign must be pasted in such a way that it does not obstruct the view to the rear. The most optimal places for placement will be the upper corners of the rear window of the car. The upper left corner is best because it obstructs the view the least. The upper right corner can also be used if there are already some stickers in the upper left.
  6. Also, do not forget that many cars have a tinted rear window, so the sign pasted from the inside will be difficult to read. For tinted cars, a sign for an exterior sticker is more suitable. Also, the glued sign on the outside is convenient in that you can ask it to be peeled off at any car wash in the spring.
  7. There are also a lot of options for signs "Spikes" for indoor installation "on suction cups" and other "Velcro". Here it must be said that the installation of such signs must be checked from time to time, since all these Velcro and suction cups tend to peel off over time.

What should be the sign "Spikes" according to GOST

It should be noted that in addition to the very presence of a sign on a car, it is also necessary that it comply with GOST.

According to GOST, the “Spikes” sign must be a white equilateral triangle with a side size of at least 20 cm, with a black letter “Ш” inscribed in it and a red border around the edges of at least 2 cm (10%) thick.

Many different signs are sold in stores and not all of them correspond to GOST; when buying, it is better to check the length of the sides of the triangle with a ruler or tape measure.

You can also print the sign yourself, just download the picture from our website:

The absence of the sign "Spikes" in an accident

As for the responsibility of the driver of a car without an established “Spikes” sign, who got into an accident, the following should be said here:

In the vast majority of cases, the fault of the driver who does not keep the distance and drove into the car in front is predetermined by the traffic police even when registering an accident.

However, the presence of the “Spikes” sign has now become mandatory and its absence on the back of the affected car can become an additional factor that the culprit of the accident can use in their favor. And under a certain set of circumstances, even turn the case in court in such a way that you become completely innocent.

The smartest thing to do is not to give the potential culprit such a great chance to confuse the case, and stick the "Spike" sign where it should be by law.

Attention! From December 8, 2018, by a decree of the Government of the Russian Federation, the obligation to glue the “Spikes” sign on the car was removed from drivers. Now its presence is only advisory in nature and is not punishable by fines.

Below is the article before the changes on December 8, 2018.

Recently, such an important document for motorists as the Technical Regulations of the Customs Union was ratified and entered into force, and from January 01, 2020, the changes affected traffic rules. Important changes were also made to the SDA on April 4, 2017 (Government Decree (No. 333 of March 24, 2017). First of all, the rules for replacing winter and summer tires, the possibility of its operation and when it is necessary to “change shoes” for a car have changed. Whether the “Spikes” sign on the rear window of a car is mandatory and whether a fine is provided for its absence is still relevant and causes a lot of discussion and controversy.

Let's try to analyze the current Code of Administrative Offenses as of 2018, judicial practice, and draw conclusions that may be useful when meeting with traffic police officers.

Is the sign "Thorns" needed or not?

Good news for those who are not in the know: at the end of 2020, some amendments were made to the current traffic rules. One of them concerned this sign. So, according to the changes, drivers are completely freed from the need to without fail install this sticker.

If anyone is interested, then earlier such a norm was spelled out in clause 8 of the Annexes to the SDA. And until the end of 2020, this norm is quite relevant. Now, at the time of writing, November 2020, the Studs sticker may not be available on a vehicle that has studded tires.

Why the changes were made

Consider a few examples of how vehicles can be equipped.

For clarity, let's take cars that differ in colors, but all are considered passenger cars and of the same brand - so that the design of the vehicle itself does not make a difference:

  • the red car has recently had its brake fluid changed, which is why its function is excellent;
  • a yellow passenger car has recently been repaired and has brand new pads and calipers;
  • green has good brake discs with a large radius, which allows you to increase the area of \u200b\u200baction;
  • the black car has studded tires, which, as you know, reduces the braking distance;
  • the white one is driven by a driver who has specially trained the reaction on the site and now slows down much earlier than other drivers usually do.

Thus, all cars will brake sooner than expected, which means that everyone should be given a warning sign, or no one should be. Following approximately this logic, the head of the traffic police explained the inefficiency of the sign.

To date, there are a large number of devices that reduce the braking distance of the vehicle. In such a case, the functionality of the small triangle is doubtful.

If you remove the pluses, then the sticker has only minuses: every season you need to take it off, then stick it on, look for shops made in accordance with GOST, while driving, find a place where it will not interfere. On this side, the sticker only contributes to the emergency, and does not help the drivers. In this regard, new features of the use of this pointer have arisen.

What proves this rule

First you need to remember that all such norms are spelled out in the traffic rules. Therefore, the obligation to install the tire was prescribed in the SDA. In order for some norm from this document to cease to operate, a Decree of the Government of the Russian Federation is needed. If it is not there, then the amendments to the traffic rules, including the cancellation, are not valid. Such a resolution has the status of such that they make changes to the current regulatory legal act, in our case, to the traffic rules.

Was there such a decision in the Russian Federation? Of course, it was, given that the sign "Tires" has been canceled. If you study history, then for the first time the Decree on about was submitted for consideration back in 2020, namely on 06/01/2018. The legislative act passed all the prescribed hearings and made amendments, although there were some conflicts. Information appeared in the media about the entry into force of the rule on the abolition of the sign even when, in fact, such a rule was not in effect. For example, on the official website of the Government, the document was published only on November 30, 2018. If we take into account that it came into force a week after publication, then this is 12/08/2018. But not November 2020, as it was presented in many publications.

The introduced amendments once again confirmed that the Government listens to the people. After all, the absurdity of the installation of this sign is obvious. Why would another driver or pedestrian need to know that a car has studded tires? The question is not at all clear, which previously caused a lot of controversy and misunderstandings.

Changes in the punishment for the absence of the letter "Sh"

So, the situations discussed above are normalized a little differently.

Now everyone does not need to designate spikes:

  1. Fans of studded tires and Velcro.
  2. Those who have additional devices that help reduce the braking distance.
  3. Owners of winter or summer tires.

In certain driving situations, studded tires can increase the stopping distance. Those driving behind will not take this into account, as they will monitor their actions and this will come as a surprise to the owner of the vehicle himself, and he will already provoke an accident with the careless behavior of the tires, which is warned about by the sign. But a long stopping distance can become.

Due to changes in legislation, it is no longer possible to fine a driver. It is logical: the punishment cannot be applied, since the sign is not considered mandatory. In addition, you do not need to make extra costs for the purchase of stickers and make sure that the sign is true, remove it in time. The traffic police warning, which was done on a par with a fine, was also abolished.

These penalties cannot be applied to vehicles with studded tires, because the driver can stick the sign or leave the glass intact - this is at his discretion. If he believes that he is creating an emergency, then for the sake of a clear conscience and warning others, the triangle can be left.

Do I need a sign of Thorns in 2020?

No. As mentioned earlier, now it is necessary to install such a sign in the presence of winter tires with spikes. The advantage is that now there will be no punishment for such a lack of an identification mark. There are already all the official documents, they are presented on the portals, and they should be guided in making a decision.

Other fines for tires out of season

Since the weather in Russia differs significantly at different times of the year, in order to avoid dangerous situations on the roads, penalties are provided for using tires that are not intended for the current season. Driving on different tires on different axles is also prohibited. That is, all 4 wheels must be equipped with the same tires for the season.

Read also: Penalty for not having a waybill

The decrease in the level of accidents on the roads in winter is also due to the fact that they introduced monetary liability for the absence of the “Spikes” sign. In addition, there are a number of malfunctions in which the car cannot be operated. According to this list and in accordance with Part 1 of Art. 12.5 of the Code of Administrative Offenses of the Russian Federation, you can get a fine for the lack of a fire extinguisher and first aid kit.

What is the punishment?

It is clear that none. If there is no obligation to install a sign, then there can be no punishment for its absence. If you do not take the time frame, then earlier the size of the punishment was 500 rubles. Another thing is that now there may be a punishment for non-compliance of rubber with the standards established in the Technical Regulations of the Customs Union. But these are completely different aspects and the topic of a separate article. For the very absence of a sign, the inspector in the current year cannot issue a fine. And this is the main answer to the question.

Background information: even if we take the precedents of past years, then an accident involving a car without an identification mark "Spikes" does not yet determine the driver's fault. Circumstances play a role, not identification marks.

Designation of the sign Ш on the car

Nowadays, even children know what the image of the letter “Sh” means on a passenger car. This image indicates a studded tire.

The Code of Road Traffic Rules contains a written addition indicating the obligation of the driver to stick the letter "Ш" on a car with studded wheels. The sticker informs about the need to maintain a distance with a studded car.

The driver of the car following him understands that it is necessary to keep a minimum distance for traffic safety. Studded wheels shorten the braking distance, which can lead to an accident.

Sign "Sh": what is it used for

The glass located behind the car with studded tires is placed on the “W” mark. Sign "Sh" can be ordered for 100 rubles. It is advisable to use it from mid-autumn. During this period, most Russian drivers are replacing smooth tires for dry weather with winter tires with spikes. In summer the signal is removed.

A sticker from afar notifies other warriors about the truncation of the braking distance of the car. The “Sh” signal will help prove innocence when considering the circumstances of an accident. A white triangle with a red border cannot be considered a trifle, it disciplines drivers, increases their attentiveness while driving.

The need to use

The document on the admission of a vehicle to exit provides for a special clause 8. It states that it is mandatory to use the “Ш” sign for cars with studded winter tires. A special sticker ensures the safety of all road users.

Additional regulations provide for an administrative fine for failure to comply with this requirement. The amount of the penalty is 500 rubles. At the same time, the document with the basic rules of behavior on the road does not contain an indication of the collection of financial punishment for violating the technical rules for operating a car with studded wheels.

The law does not provide for financial compensation for the absence of a sign on the rear window of a car. A traffic police officer will not be able to fine a driver without a sticker. He can verbally recommend setting the “Sh” label.

Judicial practice shows that the absence of a studded tire warning sticker sometimes harms the driver of a given vehicle. The court finds the driver on studded tires, who rides in front, guilty of the accident. The driver behind is the injured party, because he does not see the signal mark about the shortened braking distance of the car in front of him.

Common examples help to clarify the reasons for the decision of the court in favor of the driver riding behind. An inattentive driver in Izhevsk slammed the back of a car in front, equipped with studded wheels. But in court, he drew the judge's attention precisely to the fact that there was no "Ш" marking on the car. Therefore, the court ruled that the owner of the first car was guilty without a warning sign.

The collection of traffic regulations does not oblige the driver to check the presence of the sticker before leaving. Therefore, a fine for the absence of the "Ш" sign on the car is illegal.

Features of using the designation "Ш"

  1. Mechanics conducting a scheduled technical inspection of the car may not issue a spine on its passage due to the absence of the “W” mark on the glass. Drivers with less than two years of driving experience will be additionally advised to stick a “!” sign.
  2. The traffic police inspector has no legal grounds to issue a fine for the lack of a sticker on studded tires. If such a situation has occurred, you can go to court for proceedings. Practice shows that trips to authorities will take a lot of money and free time. To prevent this from happening, it’s easier to buy a sticker with the “Ш” sign in advance.

Every driver knows what the “Sh” sign means. The presence of such a sign awakens vigilance and attentiveness. But the owner of a studded vehicle also needs to be on the alert and keep the distance prescribed by the charter when driving.

Not always studded tires stop quickly. Experienced drivers can confirm this statement. Studded wheels help to quickly stop in heavy ice. In other emergencies the braking distance determines the condition of the roadway.

The weight of the car determines the degree of its maneuverability in extreme conditions. Therefore, it is impossible to unambiguously solve the dilemma: is it worth using studded tires in winter for your safety. Each driver solves this dilemma for himself.

Only one thing is clear: if the driver still uses it, you must purchase the appropriate sticker. The “Ш” sign on the rear window of the car will ensure the safety of all road users at any time of the year.

As soon as the cold starts, most drivers try to change summer tires to winter ones. This version of studded tires is much safer in winter weather, when it is often slippery on the roads. Many drivers are wondering if it is necessary to stick a special sign with the letter “Ш” on the car glass or can they do without it? We will try to answer this question in detail.

The inspection promised not to punish

Some people once heard that the traffic police promised to punish those who do not comply with traffic rules, including in the matter of the sign. But here, as always: they heard something, twisted something, etc. In fact, the inspectorate, on the contrary, promised citizens not to draw up protocols for such violators, even when the corresponding Resolution on cancellation had not yet been adopted. Therefore, those fines that were issued at the time of consideration and adoption of the regulatory legal act could be easily appealed. The unspoken rule of the inspectors worked - do not punish.

Inspection

The process of conducting a technical inspection of a car involves checking its compliance with a strict list of requirements that are the basis for allowing the car to participate in promotion on public roads.

Therefore, such a fact as the absence of the “Spikes” sticker on vehicles with studded tires may be the reason for refusing to carry out a technical inspection. To avoid problems and difficulties with the passage of the annual procedure, you should think about purchasing the Spikes sticker in advance.

Although you can resort to the option of replacing the wheels for the period of passing the technical inspection of the car. However, the second option cannot be called rational, since the cost of re-shoeing a car is several times higher than the cost of a sticker.

"Sh": requirements according to GOST

If someone still wants to install such a sign, then this will not be a violation either. Nobody forbade its use. And if now there may not be any special requirements for it, then earlier everything had to comply with GOST.

The following requirements were set:

  • the sign must be in the form of a triangular with equal sides, each of which is 20 cm;
  • the letter "Ш" should be in the center of the triangle;
  • the color palette is as follows: the triangle itself is white, the letter is black, and the border is red;
  • the thickness of the edging is 0.1 of the length of the side of the triangle, that is, 0.1 of 20 cm or 2 cm.

It is legally allowed to make such a sign yourself and stick it on the car. The advantage is that there were and are many templates on the Internet that could be easily downloaded, printed and pasted.

Where should it be placed

The triangular pointer should be glued on the rear of the car. Most often, rear-view glass is chosen for this, where a sign is installed in one of the corners. If the car is tinted, the letter "Ш" must be placed outside, and not from the passenger compartment. If the sign pasted on the glass interferes with the view, the pointer may be moved to the bumper or other body element.

In any case, driving on studded tires without the “Spikes” sign threatens with a monetary penalty for using a car without identification indicators, defined in paragraph 8 of the “Basic Provisions for the Admission of Vehicles for Operation” (see RF PP dated 10.23.1993 N 1090).

Sign placement

And here was the convenience of the conditions for placing the sign. There was no fixed place for him. Legislatively, it was only said that the element should be placed at the back. Where it will be is not specified. It can be glass, a lid, etc. It had to be pasted in such a way that a motorist driving behind could see the identification mark.

True, now it does not matter how it should be pasted and where. The good news is that "Sh" has become history and now you can do without such a landmark.

Sizes of a sign for self-production

Any driver who has studded their wheels can purchase a badge from an auto shop, but you can also make your own. When making your own, you need to take into account the necessary conditions:

  • It must be triangular in shape, in the middle with the letter W written in black on a white background.
  • In order for the sign to be visible at a fairly large distance, its parameters must be 20 cm or more. The sides of the figure are equal to each other.
  • The red border along the edges of the triangular background is at least 10% of the size of the side length.

There is a special regulation for the manufacture of the sign personally, where the size is specified. It is regulated by traffic rules. A4 cut sheet is ideal for one length of 20 cm.

Making Tips:

If you decide not to engage in "needlework", but to buy a ready-made identification mark, consider the following:

Pictograms in the finished form often do not correspond to the established sizes. If you install a sign that does not meet the requirements, you can get into an unpleasant situation. After all, a small pictogram will not legally count, and you will be fined.

Benefit and danger in one bottle

For the first time, the “Spikes” sign was discussed in the traffic safety services with the advent of special tires designed for driving in winter conditions.

The metal addition to the specific tread not only significantly helped drivers on snowy and icy roads, but began to create a potential danger to other road users.

Will drivers be fined for not having a spike sign under the new law? What is the penalty? Watch the video:

We list the main ones:

  1. Significant reduction in braking distance compared to other types of winter tires under the same conditions and speed;

Here is a table of average values of the inertial path when braking at a speed of 50 km/h.

Please note that the efficiency of braking on studded tires at temperatures close to "zero" is tens of meters, and sometimes even centimeters are enough to prevent an accident.

  1. Potential danger of damage to the varnish coating of bodies and the glass of cars following nearby, jumping out of the tread with spikes.

If the perpetrator is involved in an accident

In addition to the fact that a fine is imposed on the driver for driving without the “Spikes” sign, problems are not ruled out in the event of an accident. If we are talking about a so-called passing collision, when there is no “Sh” sticker on the car moving in front, but the corresponding tires are installed, the traffic police officer will note this fact. The violation will be interpreted as follows: the first driver did not warn about the shortened braking distance of the second, riding behind. This fact will be of a concomitant nature when making a decision regarding the person responsible for the accident. But at least there will be a fine. In addition, the insurance company may refuse to pay damages, also motivating its actions by the absence of a mandatory sticker.

Among the list of identification signs of traffic rules, the “Spikes” sign was perceived by drivers ambiguously for a long time: the requirement to install it when using studded tires was not always considered mandatory. At the same time, studs have a significant impact on safety, and changes in traffic legislation could not ignore this.

Until recently, the presence of the “Spikes” sign on cars with studded tires was mandatory, and a fine of 500 rubles or a warning was provided for its absence.

From December 8, 2018 the sign "Spikes" is excluded from the traffic rules(note - Government Decree No. 1414 of November 24, 2018). That is, now the presence of the sign "Spikes" on vehicles is not mandatory, respectively, and the penalty for its absence is no longer imposed.

However, there are good reasons why we encourage drivers to continue to stud their vehicles in the winter when driving on studded tires. Below you will find answers to the following questions:

  • Why was the mandatory use of the “Ships” sign canceled?
  • Why is it worth continuing to use the Thorns sign?
  • What size should the Spikes sign be and where is it best to stick it?
  • Additional information about the cancellation of the penalty for the absence of the sign "Spikes".

When the sign "Spikes" was declared mandatory for marking cars on studded tires, the logic of the legislators was that a car with such rubber brakes much sharper. Therefore, the driver following you must be aware of your spikes in order to maintain a sufficiently large distance.

In fact, contrary to this logic, the stopping distance of a car depends primarily on its mass, the presence of electronic security systems and weather conditions. In itself, the presence or absence of spikes on the tire, if it has an impact, is far from paramount.

Perhaps 30 years ago, the “Spikes” sign had some meaning when everyone drove all-weather tires and spikes were quite rare. Then, probably, cars with spikes really slowed down noticeably sharper than all other cars. But nowadays this is no longer the case.

The “Spikes” sign has lost its original meaning, since today more than 70% of motorists drive on studded tires, that is, the vast majority. Therefore, if it is necessary to mark some cars on winter tires in the stream, then it would be more logical to glue the sign on cars with Velcro, and not with spikes.

Why then stick the sign "Spikes" on the car?

The use of studded tires in winter has created not only safer and more comfortable conditions for drivers and passengers of such “re-shod” cars, but also certain problems for other road users, especially those moving behind.

The main danger from studded cars is small gravel, which can fly out from under the studded wheels and damage the car behind, or even injure the driver. And a spike flying out of a tire can also seriously damage the windshield.

By the way, experienced motorists can recall cases when traffic police inspectors concluded that cars colliding in single file on a slippery road were mutually guilty only because the spiked car in front did not have the “Spikes” identification mark. And no appeals to the fact that the rear car did not keep the required distance did not help.

Another thing is that the use of new technologies in the production of car tires made it possible to create models of winter tires that are not only not inferior in braking performance to studded tires, but also surpass them in many situations (studs or Velcro - which is better?). Therefore, the increased distance to the car in front must be observed for cars on spikes too.

What size should the sign "Spikes" be and where it is better to glue it

Prior to the abolition of the mandatory use of the “Spikes” sign, with the beginning of the winter season in car dealerships, often, the stock of stickers with its image turned out to be insufficient.

In this regard, the independent production of the sign was very relevant and many motorists needed information about the shape, size and color scheme of the sign.

  1. In accordance with the old version of the Rules of the Road, the “Spikes” sign is an equilateral triangle, inside of which the letter “Sh” is located.
  2. The triangle is located with the top up, and the length of the side is at least 20 cm.
  3. On the sides of the triangle there is a border, the width of which is ten percent of the length of the side.
  4. Color scheme: the sign has a white background, a red border, the letter “Ш” is black.

Where to download the sign "Thorns" and how to print it correctly?

If you have the opportunity to use a color printer, then the sign "Spikes" can be downloaded from this link and then printed. It is advisable to do this on thick paper, for example, photographic paper with a density of up to 150 g / m2, otherwise the sign will turn out to be short-lived.

If only a black-and-white printer is available, then we suggest downloading the black-and-white sign "Spikes", and the printout will need to be finalized: paint the border of the sign with a brush with red paint or a red felt-tip pen.

Where should the sign "Spikes" be glued?

It is necessary to glue the sign "Spikes" "behind mechanical vehicles". Most often, it is glued in the upper corner on the rear window of the car from the inside - this place is convenient both for informing the driver riding behind, and for ensuring the durability of the sign itself.

However, other installation sites do not contradict traffic rules, for example, on the bumper or on the rear trunk lid. Only in this case the sign will be exposed to precipitation and can quickly become unusable.

As for the use of a home-made "Spikes" sign of non-standard sizes, it should not be done less than the recommended minimum, but a significantly larger sign is also undesirable - when installed on the rear window, this may unacceptably restrict the driver's view.

On the cancellation of the fine for the absence of the sign "Spikes"

Previously, the absence of the “Spikes” sign was related to malfunctions in which the operation of a car is prohibited. Therefore, the punishment for failure to comply with the requirement to install it was regulated by the relevant article of the Code of Administrative Offenses:

But since the current version of the SDA does not provide for the use of the “Spikes” sign, there is no punishment for its absence either.

By the way, in accordance with the Rules of the Road, motorists are required to use winter tires from December to March. At the same time, it can be both reduced and increased by local legislation, because winter in Norilsk and in Rostov proceeds differently.

Often, motorists wonder if the reverse situation is a violation: the “Spikes” sign installed on the car in the summer (more precisely, installed in the winter and not removed in the summer). The Rules do not say anything about installing a sign in a strictly defined period, and, therefore, such a situation is not a violation, and there is no need to fear a fine. And the margin of the distance that the driver riding behind will set in the presence of a sign will not hurt at all.
